1. Definitions

1.1 “FlytoDoc”, “we”, “our” or “us” means FlytoDoc OÜ, a company registered in Estonia.
1.2 “Platform” means the FlytoDoc website and mobile applications.
1.3 “User” means any person using the Platform, including Patients, Doctors, Coordinators, Travel Agencies and Med-Reps.
1.4 “Services” means the facilitation of communication, coordination and booking between Users.

2. Scope of Services

2.1 FlytoDoc is a facilitator of medical tourism services. We are not a hospital, clinic, or healthcare provider.
2.2 Medical services are delivered solely by independent doctors and healthcare providers. FlytoDoc does not guarantee medical outcomes.
2.3 Patients are encouraged to seek independent medical advice before making any decisions.
2.4 FlytoDoc complies with all applicable provisions of the General Data Protection Regulation (GDPR).

3. User Eligibility

3.1 Users must be at least 18 years old.
3.2 Users must provide accurate and complete information during registration.
3.3 FlytoDoc reserves the right to suspend or terminate accounts in case of breach of these Terms.

4. Services and Payments

4.1 Doctors and Travel Agencies pay subscription and success fees as published on our Platform. Patients do not pay fees to FlytoDoc.
4.2 All payments between Patients and Service Providers are made directly or via the FlytoDoc payment gateway. FlytoDoc does not set medical fees.
4.3 Coordinators may set their own fees; patients are informed before confirming services.
4.4 Any “FlytoDoc Coin” or equity-related incentives are subject to applicable financial regulations and are not an investment offering.

5. User Responsibilities

5.1 Patients: provide truthful health information, comply with local laws, follow medical advice.
5.2 Doctors and Hospitals:

• Are solely responsible for the medical services and care provided to Patients.
• Must maintain valid licenses and insurance.
• Must ensure that all images, photos, or other content uploaded to FlytoDoc are owned by them or used with valid permission.
• Accept full liability for copyright or intellectual property claims arising from uploaded content. FlytoDoc bears no responsibility in this regard.
• Doctors and Hospitals acknowledge that in certain jurisdictions the use of before-and-after medical photos is restricted or prohibited. FlytoDoc reserves the right, at its discretion, to review and remove any content deemed unlawful, misleading, or contrary to applicable advertising, medical, or consumer-protection regulations. However, FlytoDoc bears no obligation to conduct such reviews or removals. Ensuring full compliance with all relevant laws and regulations remains the exclusive responsibility of the Doctors and Hospitals.

5.3 Coordinators and Agencies: act transparently, provide agreed services, and comply with local regulations.

6. Limitation of Liability

6.1 FlytoDoc is not liable for medical outcomes, delays, or acts of third parties.
6.2 We are only liable for losses directly caused by our willful misconduct or gross negligence, subject to mandatory EU consumer laws.
6.3 Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.

7. Dispute Resolution and Governing Law

7.1 These Terms are governed by Estonian law and EU consumer regulations.
7.2 Consumers may bring claims in the courts of their residence in the EU.
7.3 We encourage disputes to be resolved amicably before resorting to legal proceedings.

8. Amendments

8.1 FlytoDoc may update these Terms periodically. Users will be notified of material changes. Continued use of the Platform after updates constitutes acceptance.
