1. Definitions
- FlyToDoc: The medical tourism platform operated by FlyToDoc Inc.
- User: Any person or entity using the FlyToDoc platform, including patients, doctors, - - coordinators, hospitals, and service providers.
- Services: The services provided by FlyToDoc, including connecting patients with medical professionals and other service providers.
2. Use of the Platform
2.1 Eligibility
- Users must be at least 18 years old to use the platform.
- Users must provide accurate and complete information during registration.
2.2 Account Security
- Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
- Users must notify FlyToDoc immediately of any unauthorized use of their account.
3. Services Provided
3.1 Patient Services
- FlyToDoc connects patients with medical professionals and service providers.
- FlyToDoc does not charge patients directly. Patients pay the total amount to the doctor, who will handle payments for optional services (e.g., translation, accommodation, pick-up services) if needed.
- FlyToDoc does not provide medical advice or treatment. All medical services are provided by licensed professionals.
3.2 Doctor and Service Provider Services
- Doctors and service providers must create a profile and list their services on the platform.
- Doctors are responsible for paying their subscription and success fees to FlyToDoc through the online payment gateway.
- FlyToDoc verifies the credentials of doctors and service providers but does not guarantee the quality of services provided.
4. Payment and Fees
4.1 Fees
- Doctors are responsible for paying subscription and success fees to FlyToDoc.
- Fees for services are listed on the platform and are subject to change.
4.2 Payment Processing
- Payments are processed through third-party payment processors. FlyToDoc is not responsible for any issues arising from payment processing.
5. User Conduct
5.1 Prohibited Activities
- Users must not engage in any activity that is illegal, harmful, or infringes on the rights of others.
- Users must not use the platform to distribute spam, malware, or other harmful content.
5.2 Compliance with Laws
- Users must comply with all applicable laws and regulations when using the platform.
6. Service Quality and Liability
6.1 Service Quality
- FlyToDoc is not responsible for the quality of services provided by any player on the platform. The only quality assurance policy is based on customer ratings and reviews.
6.2 Liability
- In the event of any issue or harm to the patient, the relevant service provider (doctor, driver, translator, etc.) is responsible for all associated costs and damages, not FlyToDoc.
- Service providers are responsible for the accuracy and legality of the information they provide on the platform. FlyToDoc is not liable for any illegal content, misleading or offensive wording, miscommunication, or copyright issues.
7. Service Provider Responsibilities
- Service providers must ensure their profile and content on FlyToDoc are accurate, professional, and appealing to attract patients.
- FlyToDoc functions as a shopfront for service providers. FlyToDoc is not responsible for the performance of the service provider's page. Providers should improve their page content quality to be more convincing for patients.
8. Dispute Resolution
8.1 Disputes Between Users
- FlyToDoc is not responsible for resolving disputes between users. Users are encouraged to resolve disputes directly.
8.2 Disputes with FlyToDoc
- Any disputes arising from the use of the FlyToDoc platform will be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce.
9. Limitation of Liability
- FlyToDoc is not liable for any indirect, incidental, special, or consequential damages arising from the use of the platform.
- FlyToDoc's total liability to any user for any claim arising from the use of the platform is limited to the amount paid by the user for services in the six months preceding the claim.
10. Indemnification
- Users agree to indemnify and hold FlyToDoc harmless from any claims, damages, or expenses arising from their use of the platform or violation of these Terms and Conditions.
11. Termination
- FlyToDoc may terminate a user's account and access to the platform at any time, without notice, for any reason, including violation of these Terms and Conditions.
12. Changes to Terms and Conditions
- FlyToDoc reserves the right to modify these Terms and Conditions at any time. Users will be notified of any changes, and continued use of the platform constitutes acceptance of the modified Terms and Conditions.
13. Governing Law
- These Terms and Conditions are governed by the laws of the Republic of Turkey, without regard to its conflict of laws principles.
